Transferring Leases and Licences

Crown land in Tasmania is managed by various Government agencies. The information below relates solely to Crown land managed under the Crown Lands Act 1976 by Crown Land Services.

An agreement holder may apply to transfer a lease or licence to a third party.  To initiate a transfer lodge a Transfer Request form together with the applicable fee. 

Approval is not automatic.  Requests are subject to investigation and assessment.  The extent of these processes largely depends on the location and type of Crown land involved. 

Applicants must allow plenty of time for a transfer request to be considered. This is particularly important when selling real property, like a jetty, because the sale of the property is separate to requesting approval to transfer the Crown land agreement.

A transfer will not occur while there are outstanding rental fees.

Until an agreement is signed by the Crown and the new party, the transferor remains the agreement holder and rates notices and rental fees (if applicable) will continue to be forwarded to that person.
